The following provisions apply to information Topix Media Lab LLC and/or its affiliates (“Topix”, “we”, “us”, or “our”) collects or obtains from you when you visit or use our website, our services, applications we make available on third-party sites or platforms, and our other offerings (each a “Site,” or collectively the “Sites”). This Privacy Policy applies to any Site that links directly to this policy. By accessing and/or using a Site, you agree to be bound by the provisions of this Privacy Policy.
These provisions may be changed from time to time and without notice, at Topix’s sole discretion and as provided by applicable law. You should check this Privacy Policy frequently for any such changes, but in any case your continued access or use of the Sites shall constitute acceptance of any modifications of the Privacy Policy. Topix’s use of information gathered or obtained now is subject to the Privacy Policy in effect at the time of such use.
General
The Site is intended to be interesting and useful to visitors of all ages. Topix values the privacy and safety of children (and adults) who may visit the Sites. If you are under age 13, you must obtain your parent or guardian’s consent before providing any personal information to a Site. This Privacy Policy explains what you need to do. If you are a child under age 13 and have questions about these Terms, or anything else on the Sites, please ask your parent or guardian for help.
What We Collect
Information You Give Us: Topix receives and stores any information you enter on the Sites (for example, when you register with a Site or participate in contests, events or promotions) or provide in any other manner, including via e-mail. This may include your personally identifiable information, such as your name, e-mail address, home address, phone number or other personally-identifiable information (“Personal Information”). Topix may also collect general demographic information, such as your age, hobbies, and other preferences. Topix will only collect personal information reasonably necessary to comply with your requests and with Topix’s legitimate business interests. Of course, you can choose not to provide such information, but you might not be able to access certain sections of the Site or use certain services. Topix uses the information that you provide for such purposes as facilitating your use of the Sites, responding to your requests for information, improving the products and services we offer, and communicating with you regarding special events, news, announcements and other topics.
Children Under Age 13: We do not knowingly collection information from children. On some Sites, we may ask you to provide us with your age information. If you indicate you are under age 13, Topix will (i) collect no or limited personal information (e.g., persistent identifier and/or email address only) from you; (ii) inform you that your parent or guardian’s verifiable consent is required; and/or (iii) collect the email address of your parent or guardian. We may use the parent or guardian’s email address to seek verifiable consent or notify the parent or guardian of your online activities and enable them to unsubscribe you from a newsletter or other similar activity. If you are under age 13, we will not condition your participation in an online activity on the disclosure of more personal information than is reasonably necessary to participate in the activity.
Resumes: Your personal information contained in any resume or application for employment you submit to the Site will be used solely for the purpose of evaluating you for possible job openings with Topix and/or its affiliates, and for responding to your requests for information regarding such openings.
Information You Provide Through Social Media: You can engage with some of our content and offerings on or through third-party communities, forums, and social media sites, platforms, services, plug-ins, and applications (“Social Media Sites”). When you link to or interact with our Sites, content, or offerings through Social Media Sites, you may allow us to receive certain information from your social media account (e.g., name, user ID, email address, profile photo, photos and videos, gender, birthday, location, your friends and their contact details, people you follow and/or who follow you, posts, ‘likes’, and other user-generated content). We may also receive information from your interaction with our content (e.g., content viewed and information about advertisements you may have been shown or have clicked on). By providing this information, or otherwise interacting with our Sites through Social Media Sites, you consent to our use of information from the Social Media Sites in accordance with this Privacy Policy.
Automated Information Collection: Topix receives and stores certain types of information whenever you visit the Site. In addition to information you provide, we may collect the name of the domain and host from which you access the Internet; the IP address of the computer you are using; the browser and operating system you are using; the date and time you access the Site; and the Internet address of the website from which you linked to the Site. We use “cookies” to automatically gather some of this information. A cookie is a small text file that Topix’s system sends to your computer to collect information about your activities on the Site. The cookie transmits this information back to the Site each time your browser requests a page from the Site, and the information is stored to help facilitate your use of the Site the next time you visit. If you do not want to receive cookies from the site, you can set your browser to not accept cookies.
How We Use Information
We use the information you provide and we collect to:
- Administer the Site and diagnose problems with our server;
- Verify your identity;
- Provide you with information about the Site and Topix and our products and services;
- Communicate with you to notify you when you win one of our contests or sweepstakes or when we make changes to our policies or user agreements;
- Fulfill your requests for our products, programs, services and content;
- Provide or analyze your use of our products, programs, services and content;
- Facilitate sharing and other interactions with Social Media Sites;
- Provide, develop, maintain, personalize, protect, and improve your experience and our offerings; and
- Measure the number of visitors to the Site and how the Site is used, in order to make the Site as useful as possible to our visitors.
Sharing Information
We do not share information collected or obtained from you with any third parties, except as described herein. If you choose to submit content for publication online or in other forums, we may publish your screen name or username and any other information you have provided to us on our Sites, the Internet or elsewhere. In addition, we may disclose information when you provide us with your consent to do so. Organizations that perform services for us may have access to information to help carry out the services they are performing for us, such as, but not limited to, creation, maintenance, hosting, and delivery of our Sites, products, and services, conduct marketing, handle payments, email and order fulfillment, administer contests, conduct research and analytics, protect our rights and the rights of others, prevent fraud, illegal activities, or violations of our terms of use or other rules, or provide customer service.
Links
The Site may contain links to other sites. These links are for the convenience of visitors to the Site only, and Topix makes no representations whatsoever regarding such other sites. You should review the privacy policies of other sites carefully before providing any information to such sites. Topix is not responsible for the privacy policies or procedures or the content of any other site.
Security
Topix has reasonable security measures in place to protect against the loss, misuse, or alteration of your information under Topix’s control. However, no security measures are perfect, and we cannot assure you that Personal Information that we collect will never be accessed or used in an unauthorized way.
Subpoenas
Topix does not disclose the identities of visitors or users of the Site unless legally required to do so. We will respond to any subpoena received from a government agency (i.e., the Securities and Exchange Commission or law enforcement agencies) without prior notice to you. Unless prohibited by law or by a valid court order, we will notify you of any subpoena received from any other party (i.e., for civil litigation) which requires us to disclose your identity, and will wait ten (10) days, or a lesser amount of time as required by the deadline in the subpoena, before providing the information requested by the subpoena.
Change of Control
We may transfer information in the event of a business transaction, such as if we or one of our business units or our relevant assets are acquired by, sold to, or merged with another company or as part of a bankruptcy proceeding or a business reorganization.
Opt-Out
If you want your name removed from Topix’s database or to change or modify any of your information collected by Topix, you may do so by:

We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your information, access or deletion rights. As part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
- Request a list of third party marketers. California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any). You can submit such a request by sending an email to info@topixmedia.com with “Shine the Light” in the subject line. The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident.
